Abstract

The main direction of the state policy in Ukraine is to form effective economic and legal mechanisms for relationship regulation in the waste management sector. It is oriented to create national resource-effective system for waste management with both material and energy flows, based on zero waste and circular economy principles. The object of this article is to improve the economic and legal mechanisms of waste management in Ukraine. The following tasks are set to solve it: to analyze the problems in the waste management sector; to define essence of the economic and legal mechanisms in the waste management sector and its main constituents, to develop methods and tools to control the waste management system. Results. The analysis of the current problems in waste management sector leads authors to distinguish those ones, without solving of which it is impossible to provide efficiency and effectiveness of the national waste management system. Therefore, authors have systematized the current problems of waste management system control and distinguished their three main groups: legal, economic and social. Moreover, although Ukraine assumed legal responsibilities to solve problems in the wastes field, the regulatory framework in the waste management sector in Ukraine has not yet been coordinated with EU Waste Directives, including those ones, which Ukraine has to adopt according to Association Agreement. The main waste management principles of EU have not been realized yet. Basic vocabulary, used in the proper acts of Ukraine, is not conformed to definitions in the EU waste regulatory documents. It is defined, that problems in the legal regulation, particularly at the stage of law enforcement and realization in the waste field, in delay of proper EU standards introduction, lead to legal uncertainty, which discredits foreign investors. The suggested economic and legal controlling mechanism of the waste management system has to be oriented to solve the problems mentioned above. Economic and legal controlling mechanism of the waste management sector is proposed to be defined as a system of relationship between stakeholders, based on principles, elements, economic and legal means of the managerial impact, used to regulate ecological and economic legal relations for state’s ecological policy tasks and objectives achievement. The observed economic and legal controlling mechanism of waste management sector is a system which presents internal essence of its constitutes and its dynamic component, the one system of legal means, ways and forms, owing to which legal norm is coordinated by relations, establishing law and order and performing the regulatory impact. The mechanism dynamics is expressed through realization and interconnection of legal means at various stages of the legal regulation: law-making, law enforcement and realization. Authors determined that main constituents of the given mechanism include target, controlling, controlled, functional, and proving subsystem. Based on the legal norms system analysis, its improvement ways are suggested in the part, which concerns some regulations. Their realization leads to increased efficiency of the waste management system control. Conclusions and perspectives for further studies. Integral results of the performed research consist in the theoretical and practical bases for relations control deepening in the waste management sector and improvement of the economic and legal controlling mechanism in this sector. Authors formed positions, which lead to investigate theoretical and methodic approach to the breakthrough management in the waste management sector as a global system, in further studies. Besides they will develop mechanism of relations between countries, which will assist formation and innovative development of the waste management national systems, based on net cooperation and state-private partnership. Thus, issues, formed by authors, lead to develop theoretical and methodic approach to the breakthrough management in the waste management sector as a global economic system. Besides, relationship mechanism on waste management between countries is developed, which will facilitate formation and innovative development of waste management national systems, based on the net cooperation and state-private partnership.
